This court has jurisdiction over plaintiffs' state law claims of strict liability, negligence, loss of consortium and negligent infliction of emotional distress under the diversity of citizenship statute. In essence, plaintiff alleges that defendants should have alerted competitors to the hazards associated with rollovers and of competing while riding a tractor not equipped with some sort of roll bar protection system. Rose, his wife and children have sued the organizations responsible for setting the standards that govern tractor pull competitions, defendants National Tractor Pullers Association, Inc. During this competition, plaintiff Randall Rose sustained serious injuries after his tractor, an 1,800 horsepower, turbo-charged behemoth, rolled over on top of him.
